Unique opportunity to join McKesson’s Pharmaceutical Solutions and Services legal team as a junior staff attorney supporting Biologics by McKesson, a leading specialty pharmacy for limited access drugs for the treatment of cancer and other complex and rare diseases. Reporting to the Managing Senior Counsel and working directly with the business team of Biologics by McKesson, the Staff Counsel possesses exceptional professional judgment and provides decisive day-to-day legal counseling and advice to all levels of the organization. You will be a critical member of a collegial and highly experienced team responsible for managing all legal aspects of the company’s active pharmaceutical buyside distribution team and will have the ability to advance as you develop critical skills and demonstrate readiness for increased responsibility.

Current Need:
Position will primarily be dedicated to supporting Biologics by McKesson. This position requires a keen understanding of the ever-changing business, legal, and healthcare regulatory environment relevant to McKesson’s commercial contracts with pharmaceutical manufacturers and pharmacies. Agreement types may include, without limitation, manufacturer supply and service agreements, 340B Contract Pharmacy Agreements, payor agreements, and other business partner/vendor agreements, consulting services agreements and software services agreements. The successful candidate will be expected to serve as a role model of professionalism and demonstrate strong leadership traits as part of a mutually supportive, highly engaged team with an exceptional reputation for performance and positive culture.

Key Responsibilities:
  • Provide day-to-day counseling and issue identification and escalation to senior attorneys, as appropriate; Serves as an initial point of contact for many legal matters within the business unit
  • Drafts, reviews, analyzes and negotiates contracts and provides guidance on contract positions to ensure successful completion or resolution, with escalation to senior attorney as appropriate
  • Identifies, analyzes, researches, and resolves legal and business process issues and escalates or makes appropriate recommendations to business and senior attorney
  • Identifies and analyzes risks in business proposals or proposed legal agreements and escalating appropriately to business and legal leaders
  • Develops an excellent rapport with the business teams and earns the trust of business leaders
  • Identifies and analyzes risk, determines the level of risk and required escalations appropriately
  • Consults on legal and business provisions in contracts; Coordinates contract approval and enforcement of delegations of authority as needed
  • Monitors compliance with internal McKesson business and legal processes and policies
  • Prepares legal presentations for the senior attorneys and presents to senior leaders, as appropriate
  • Prepares contract summaries and/or issues lists and researching relevant guidance/laws to present to senior attorney or business unit partners for review, as applicable.
  • Demonstrates comprehensive understanding of McKesson business units (BUs), products, strategy, and operational model
  • Recommends and implements contracting policies, procedures and processes
  • Coordinates with colleagues to identify regulatory issues, assess business impact risk and communicate same to business partners
  • Collaborates with a team of legal professionals that provide cross-functional support services for the above areas

Qualifications:
  • Minimum Requirements 2+ years of legal experience in a corporate legal department or law firm
  • Experience with basic corporate law principles and contract drafting
  • Familiarity with healthcare, life sciences, pharmaceuticals, medical devices, wholesale and/or distribution a plus

Critical Skills:
  • Experience with high-volume, sales-driven, complex commercial contracting – much of it in a healthcare context.
  • Experience providing business-focused legal counsel to a corporate client in the healthcare sector, as in-house counsel or in a healthcare-focused practice group of a law firm.
  • Experience working for or closely with one or more of the following: pharmaceutical manufacturers, health plans, pharmacy benefits managers, hospitals, physicians or pharmacies.
  • Highly Proficient in Microsoft Office applications (Outlook, Word, Excel, PowerPoint, OneNote) OneDrive, SharePoint and general Intranet and Internet research skills.
  • Exceptional written and oral communication skills with emphasis on knowing the audience.
  • Ability to present information, clearly, concisely and logically.
  • Ability to work effectively with clients and promote the reputation and integrity of McKesson and the McKesson Law Department.
  • Experience communicating effectively with all levels of personnel, both internal and external to the organization.
  • Ability to create, tailor, and deliver impactful educational presentations to other legal professionals or non-legal business leaders on complex legal topics in an understandable, engaging way.

Education:
  • Juris Doctor Degree with excellent academic credentials
  • Member of a state bar in good standing
