Administrative Law Judge I (Administrative Law Judge)
The Administrative Law Judge (ALJ) presides over contested case hearings on indemnity disputes arising under the Texas Workers’ Compensation Act. The ALJ will also preside over appeals of independent review organization decisions regarding determination of medical necessity for a health care service. Travel is required as needed and will vary based on the workload at the Administrative Law Judge’s permanent place of assignment.
This position:
- Conducts contested case hearings involving indemnity and medical necessity disputes with duties that include ruling on prehearing matters and motions, swearing in witnesses, receiving testimony, allowing examination and cross-examination of witnesses, accepting documentary evidence, allowing the presentation of evidence by summary measures, ensuring the rights of the parties are preserved, and fully developing the facts required to permit making the factual determinations necessary to resolving the legal issues in dispute.
- Judges the relevance and materiality of the evidence offered and the weight and credibility to be given to the evidence and resolves the issues in dispute based on current legal precedent.
- Assists with quality assurance processes as required.
- Writes a Decision and Order (D&O) that resolves the disputed issues and is legally, factually, and grammatically correct. Writes a D&O following established formats, models, and guidance. The D&Os will be submitted within the 10-day time limit.
- Accurately generates various work products daily with limited clerical/administrative assistance, including ruling on motions and issuing procedural orders.
- Completes required computer data entries that memorialize any contact with parties to a claim.
- Acts timely on all attorney fee requests.
- Performs other duties as assigned.
This position requires:
- Graduation from an accredited law school with L.L.B or J.D. degree.
- Two years of experience as a practicing attorney.
- License to practice law in the State of Texas.
- Member in good standing with the State Bar of Texas.
Additional job details:
This position may be eligible for hybrid telecommuting. Employees must have a secure, dedicated workspace with Internet service, the ability to maintain a reliable consistent work schedule and be available for weekly meetings and group collaboration via Microsoft Teams and other applications during regular business hours.
The interview will include a writing test.
Preferences for this position include:
- Experience in the Texas Workers’ Compensation system and prior experience as an administrative law judge or litigator.
This position requires demonstrated knowledge of:
- The Texas Workers’ Compensation Act and Rules.
- Medical terminology.
- Word processing and personal computers.
This position requires demonstrated skill in:
- Planning, decision-making, and problem-solving.
- Effective oral and verbal communication.
- Using computer software applications, including Microsoft Office.
- Operating a motor vehicle in a safe and courteous manner in compliance with traffic laws.
This position requires the demonstrated ability to:
- Communicate clearly and concisely, both orally and in writing.
- Apply critical thinking to evaluate, analyze, and interpret information.
- Establish and maintain effective working relationships with both internal and external customers.
- Conduct hearings and write decisions that are legally and grammatically correct, with limited administrative and clerical support.
- Learn the American Medical Association guide for impairment ratings.
- Manage multiple tasks and meet deadlines.
- Manage complex and highly technical functions.
- Prioritize workload.
- Satisfy the requirements to maintain a fully qualified driving status.
