Job Title: Legal Counsel/Auditor (hybrid)

Location: US-GA-Atlanta (Sandy Springs)

FLSA: Exempt

Job Overview:

This position performs complex legal research and analysis in order to monitor legal requirements and risks associated with the company’s business operations. The position manages audits conducted by regulators and business partners as well as assessing the company’s various departments’ compliance with its contractual duties and associated regulatory requirements. This position will oversee projects that are complex and require significant expertise in insurance/insurance-like products as and compliance.

Essential Functions:

Under general direction, assists in the analysis of the company's legal posture and the development of control recommendations. Interacts with all of the company’s departments to ensure compliance with regulations and contractual requirements.

  • Conduct, manage, and support compliance auditing/monitoring of programs and products and maintain knowledge and understanding of relevant industry regulations and guidelines.
  • Lead and/or participate, with limited direction, in complex cross-functional internal committees charged with reviewing, creating, updating and maintaining Safe-Guard compliance, ethics and related role-based compliance manuals.
  • Act as the Legal and Compliance point-of-contact for regulatory or partner audits.
  • Monitor regulatory and legislative changes to determine the impact upon company’s customer agreements, filings, licenses, rates, marketing materials etc.
  • Provides support to company’s Direct to Consumer channel and Privacy/Data Security team with specific focus on emerging privacy laws and telemarketing regulations.
  • Conduct audits of the company’s programs, products, licenses, and business behavior as well as the Legal and Compliance department’s responsibilities and output to ensure compliance with applicable laws and regulations.
  • Develop and maintain an in-depth understanding of Safe-Guard’s business, organizational structure, reporting relationships, core business practices, policies & procedures, as these relate to new product and program implementations.
  • Develop, document and manage processes and procedures for the Legal and Compliance related implementation of those legal/compliance related implementations, including creating and maintaining company’s statutory/regulatory informational documents and matrices.
  • Assist with other legal and compliance duties and/or projects including but not limited to matters related to operations, privacy, audit, transparency areas, legal contracting and litigation/complaints management.
  • Conduct a “deep dive” into details of a business while staying focused on the big picture
  • Provide value-added recommendations to support the long-term growth of the department.
  • Play role in proactive research, evaluation and recommendations associated with evolving industry related compliance legislation and regulations. Includes benchmarking and staying abreast of other industry and marketplace developments and best practices to determine and shape Safe-Guard’s policies & policy guidelines.
  • Proactively identify and address potential compliance issues.
  • Maintain daily contact with client and other members of working group to obtain information and resolve issues, attend working group meetings, and facilitate the adoption and implementation of recommended improvements.

Qualifications:

  • JD degree from accredited law school. Minimum 1-2 years of compliance experience.
  • Related industry compliance experience strongly preferred. Related industries include our direct competitors, Automotive F&I industry, home warranties, consumer goods service contracts or insurance industry required.
  • Experience in telemarketing and privacy related regulations.
  • Advanced skills in Microsoft Office applications.
  • Knowledge of MS Project.
  • Proficiency with spreadsheets, database applications and document management software.
  • Proficiency with software, including Nils, Serff, Westlaw, ODEN and internet research.
  • Experience working with the state and federal legal and regulatory agencies preferred.
  • Experience in legislative review, analysis and reporting preferred.
  • Deep technical knowledge of service contracts, debt cancellation agreements, vehicle protection products, motor club products, and insurance products, processes and services preferred
  • Experience developing and maintaining compliance programs and procedures preferred.
  • Demonstrated history of establishing relationships with State Insurance Department (and other relevant regulatory agencies’) personnel and examiners preferred.
  • Experience handling corporate licensing and other functions related to the operations of a third-party administrator preferred.
  • Detail oriented, organized and patient individual.
  • Excellent verbal and written communication skills.
  • Ability to do compliance research.
  • Strong leadership, project management and relationship management skills.
